Claude vs ChatGPT - GDPR & Data Privacy Comparison for European Clients

1 Purpose
This report compares how Claude (Anthropic) and ChatGPT (OpenAI) handle personal data in relation to the General Data Protection Regulation (GDPR), with a focus on European customers. Both are general-purpose assistants with consumer, business, enterprise, and API routes, but they differ most on one point that matters for EU procurement: EU data residency.

Bottom line: Both vendors give you a genuine no-training commitment on their business and enterprise tiers. The decisive difference is how you get EU data residency: ChatGPT can keep eligible Enterprise/Edu and API data in Europe natively, while Claude requires you to deploy through a cloud provider's EU region (Bedrock or Vertex) to achieve the same.

A ✅ marks that a capability is available - not how capable or mature it is. Where each tool genuinely excels is summarised below.
What each is best at
- Claude (Anthropic) - the execution leader. It builds and edits real work: Excel models, PowerPoint decks and Word documents through its in-app plugins and code execution, and handles long documents in full context. Its real edge is tool calling: where in ChatGPT you pick the right Custom GPT yourself, Claude works out on its own which skill or tool to call for the task - an AI deciding which AI to use, which is what makes it a genuine agent. Anthropic also pioneered the open standards the rest of the industry is now adopting - MCP for connectors and Skills for reusable, packaged expertise.
- ChatGPT (OpenAI) - the reasoning and breadth leader. Strongest for reasoning through complex documents and high-stakes analysis, plus the widest toolkit: Custom GPTs (a more mature store than Claude's Projects), native image generation, and voice.
Our take: it's an AND, not an OR. In our hands-on use the split is consistent: reach for Claude to build and execute - Excel, PowerPoint and Word, file-heavy work, and agents that call their own tools; reach for ChatGPT to reason - thinking through complex documents and analysis - and for Custom GPTs, image and voice. The strongest teams run both (often Gemini too) and let them check each other.
Claude is much better at Excel and PowerPoint, while ChatGPT is much better at reasoning - it's an AND, not an OR.

- The EU-residency path: The direct Anthropic API offers only
"us"and"global"inference geographies - there is no dedicated EU-only option. For EU residency, route Claude through AWS Bedrock EU inference profiles or Google Cloud Vertex AI EU regional endpoints, where the cloud provider's DPA applies. Consumer tiers (Free/Pro/Max) should not be used for EU personal data; verify your training opt-out atclaude.ai/settings/data-privacy-controls.
5 Key differences
- EU data residency is the headline. ChatGPT offers native EU residency on eligible Enterprise/Edu workspaces and API projects. Claude's first-party plans store data in the US; genuine EU residency requires deploying via AWS Bedrock or Google Vertex AI EU regions.
- No-training commitments are comparable on business/enterprise tiers: ChatGPT (Business/Enterprise/Edu/API) and Claude (Team/Enterprise/API under Commercial Terms) both exclude your data from foundation-model training by default.
- Consumer-tier defaults differ in direction: ChatGPT consumer plans train by default and you opt out; Claude consumer plans, since Oct 8, 2025, default to opt-in for training with up to 5-year retention. In both cases, do not process EU personal data on consumer tiers.
- Certifications: Anthropic holds ISO 42001 (AI management system) in addition to ISO 27001 and SOC 2; OpenAI maintains SOC 2 and an enterprise compliance programme.
- Regulatory history: OpenAI faced (and ultimately overturned) the Italian Garante's €15M fine; the Irish DPC is its lead supervisory authority. Claude has no equivalent headline EU enforcement action to date.
6 Recommendations (GDPR-first)
- If you need EU data residency with the least integration effort: ChatGPT Enterprise/Edu (or an eligible OpenAI API configuration) keeps covered data in Europe natively.
- If you prefer Claude (e.g. for reasoning, long context, or Claude Code): deploy through AWS Bedrock EU profiles or Google Vertex AI EU regional endpoints to obtain EU residency, and enable Zero Data Retention where required.
- For either vendor: sign the DPA, complete a DPIA for personal or special-category data, configure retention, and use SSO/admin controls on enterprise tiers.
- Never process EU personal data on consumer tiers of either tool; on Claude, verify the consumer training opt-out explicitly.
7 Decision guide
- Microsoft-centric organisation already standardising on Office: ChatGPT (or Copilot) usually integrates with the least friction; ChatGPT gives native EU residency on Enterprise/Edu.
- You want the strongest no-training + AI-governance certification posture: Claude's ISO 42001 + Commercial Terms are attractive, provided you accept the Bedrock/Vertex EU deployment path.
- Developers / agents: both offer API + ZDR; Claude requires Bedrock/Vertex for EU residency, OpenAI's API supports eligible EU projects directly.
